Terms and Conditions for CreateQR.app

These Terms and Conditions ("Terms") govern your use of CreateQR.app and related services provided by PAYDOTCOM SRL ("CreateQR", "we", "us", or "our").

By accessing or using CreateQR, creating an account, starting a trial, purchasing a subscription, using the API, or using any hosted QR page or feature, you agree to these Terms.

1. Eligibility and accounts

You must provide accurate information when creating an account and keep your account details up to date.

You are responsible for:

  • maintaining the confidentiality of your login credentials and API keys;
  • all activity under your account, unless caused by our own fault;
  • making sure your use of the service complies with these Terms and applicable law.

You may sign in using email/password or a supported third-party login such as Google.

CreateQR is not intended for children.

2. Our service

CreateQR is a SaaS platform that allows users to create, manage, publish, host, and analyze QR codes and related public landing pages and content. Features may include:

  • static and dynamic QR codes;
  • hosted public landing pages;
  • analytics and scan tracking;
  • feedback and review collection;
  • file-based QR experiences;
  • API access;
  • billing and subscription management.

We may add, remove, improve, or modify features from time to time.

3. Plans, trials, and subscriptions

We may offer free plans, paid plans, and promotional or trial access.

If we offer you a 7-day trial of paid features:

  • the trial lasts for the period shown at signup or checkout;
  • unless canceled before the trial ends, the trial may convert into a paid subscription for the selected plan;
  • the plan will then renew automatically unless canceled.

Paid subscriptions:

  • are billed through Stripe or another payment provider we choose;
  • renew automatically on the billing cycle shown at checkout unless canceled;
  • may include taxes where applicable.

You authorize us and our payment processor to charge the applicable subscription fees, taxes, and other amounts due for your selected plan.

4. Cancellation and auto-renewal

You can cancel your subscription at any time through the billing area or Stripe customer portal where available.

If you cancel:

  • your subscription remains active until the end of the current paid billing period;
  • we do not charge the next renewal after cancellation is processed;
  • access to paid features ends at the end of the current billing period unless otherwise required by law.

If your subscription is canceled because of payment failure, abuse, fraud risk, or a Terms violation, access may be suspended sooner where reasonably necessary.

5. Refunds and EU consumer withdrawal rights

Our 7-day trial is designed as the no-charge evaluation period before your first paid billing cycle.

To avoid your first paid charge, cancel before the trial end date shown in your account or checkout flow.

After a paid subscription charge is processed, fees are non-refundable, except:

  • where a refund is required by applicable law; or
  • to correct verified billing errors (for example, duplicate charges caused by a payment processing issue).

If you are a consumer in the EU or EEA, you may have a statutory 14-day right of withdrawal for a new paid subscription purchased at a distance, unless an exception applies under law.

Because CreateQR is a digital service, we may ask you during checkout or activation to:

  • expressly request immediate access to the paid service; and
  • acknowledge that your withdrawal right may be reduced, lost, or limited once the digital service has started or been fully performed, to the extent allowed by law.

Where required by applicable law, we will honor valid withdrawal requests and any mandatory refund rights. This section does not limit any non-waivable consumer rights you have under applicable law.

Outside mandatory legal rights and verified billing error corrections, we do not provide discretionary refunds.

6. Pricing changes

We may change plan prices, limits, features, or packaging from time to time. Price changes will apply prospectively, not retroactively, and we will provide notice where required by law or reasonably appropriate.

7. Acceptable use

You may use CreateQR only for lawful purposes and in line with these Terms.

You must not use CreateQR to create, store, publish, link to, distribute, or promote content or destinations involving:

  • phishing;
  • malware;
  • spam;
  • copyright infringement;
  • illegal products or services;
  • deceptive or fraudulent activity;
  • hateful, abusive, or harassing content;
  • content that violates the rights, privacy, or safety of others.

You must not:

  • interfere with the service or its security;
  • attempt unauthorized access to accounts, systems, or data;
  • bypass plan limits, rate limits, quotas, or security controls;
  • use the service in a way that could damage the platform or other users;
  • reverse engineer or misuse non-public parts of the service except where prohibited by law from restricting that activity.

8. User content and public pages

You retain ownership of the content you upload or create, subject to the rights needed for us to operate the service.

By uploading, publishing, or creating content on CreateQR, you grant us a non-exclusive, worldwide, royalty-free license to host, process, reproduce, adapt, display, and distribute that content only as needed to provide, secure, improve, and support the service.

You represent that:

  • you have the rights and permissions needed to use the content;
  • your content does not violate law or third-party rights;
  • if you collect data from your own users or visitors using CreateQR, you will provide any notices and obtain any consents required by law.

Public QR pages, destinations, and feedback forms may be visible to anyone who scans the QR code or has the link.

9. API terms

If your plan includes API access:

  • you may use the API only in accordance with these Terms, our documentation, and your plan limits;
  • you must keep API keys confidential and secure;
  • you must not embed secret API keys in public frontend code;
  • quotas, monthly limits, and rate limits may apply;
  • we may suspend, rotate, or revoke API access for security reasons, abuse prevention, or Terms violations.

We may monitor API usage for security, billing, quota enforcement, abuse prevention, and service improvement.

10. Moderation and enforcement

We may investigate, remove, disable, restrict, suspend, or terminate content, QR codes, public pages, redirects, API keys, or accounts where we reasonably believe there is:

  • a violation of these Terms;
  • illegal activity;
  • abuse, spam, or fraud risk;
  • phishing, malware, or security threats;
  • infringement of third-party rights;
  • risk to other users, our systems, or the public.

We may also cooperate with law enforcement or other authorities where required by law.

11. Intellectual property

CreateQR and its software, branding, site design, documentation, and related materials are owned by us or our licensors and are protected by applicable intellectual property laws.

Except for the limited right to use the service under these Terms, no rights are granted to you in our intellectual property.

12. Availability and changes

We work to keep the service available and fast, but we do not guarantee uninterrupted or error-free operation.

We may:

  • perform maintenance;
  • release updates, bug fixes, and security changes;
  • change or discontinue features;
  • impose limits to protect the platform.

We are not liable for downtime, delays, or interruptions caused by factors outside our reasonable control.

13. Account deletion and termination

You may stop using the service at any time. If self-service account deletion is available, you may request deletion through your account settings.

We may suspend or terminate access, with or without notice where appropriate, if:

  • you violate these Terms;
  • payment fails;
  • we detect abuse, fraud, or security risks;
  • we are required to do so by law.

Termination does not affect amounts already owed or rights that by nature should survive termination.

14. Privacy

Our handling of personal data is described in our Privacy Policy. By using CreateQR, you acknowledge that we may process personal data as described there.

15. Disclaimers

To the maximum extent permitted by law, CreateQR is provided on an "as is" and "as available" basis.

We do not guarantee that:

  • the service will always be uninterrupted, secure, or error-free;
  • all QR destinations, scans, analytics, or public pages will always be available;
  • the service will meet every specific business, legal, or regulatory requirement you may have.

You are responsible for reviewing and testing your QR content, destinations, public pages, and campaign setup before public use.

16. Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities;
  • our total aggregate liability arising out of or relating to the service or these Terms will not exceed the total amount you paid us for the service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Governing law and consumer rights

These Terms are governed by the laws of Romania, without prejudice to any mandatory consumer protections that apply in your country of residence.

If you are a consumer, nothing in these Terms removes rights that you cannot legally waive under applicable consumer law.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may notify you by updating the page, emailing you, showing an in-app notice, or using another reasonable method.

Your continued use of the service after the updated Terms take effect means you accept the updated Terms, except where applicable law requires a different process.
